The Right to Fight

To: Supreme Court of Georgia

On October 5th 2009 my sister, Attica, went into CCU (Critical Care Unit) outside of Atlanta GA with pneumonia complicated by the swine flu. For almost a week and a half her situation was bad. She was crashing at least once a night, and her lungs wasn't able to work well on their own due to the large volume of fluids in them. Finally after 12 touch and go days she began to come out of it. She beat the swine flu!! The antibiotics were finally working, the blood transfusion lifted her immune system, and she had received a Tracheotomy to allow her to come off of the chemical sedation and paralysis meds she was on. With in 30 minutes of receiving the tracheotomy her face and neck began to swell. My mother, in the room for the entire surgery, was the first and only one to notice the swelling. After notifying the CCU staff they took action and had her back on her way to recovering again. On Monday October 20th my sister awoke from her sedation and to everyone's relief didn't show any signs of brain damage. Despite the inability to speak and move (due to being chemically paralyzed for so long and the tracheotomy in her neck) she was herself! Alert, aware of her surroundings and of what was going on.

On October 21st, at age 38, my sister died from the same episode that had happened less then 30 minutes after the tracheotomy was done. This time our Mother was not there to catch it for the hospital. The tracheotomy came completely out of my sister's neck. No one was watching her (it was about two in the morning) and the air/pressure was allowed to fill into her body and it basically blew her up like a balloon.

The surgeon that put the tracheotomy in insisted the autopsy be done at a location not affiliated with the hospital she passed away in. At that point we began to seek legal counsel to pursue a wrongful death suite to find out who was responsible for this mistake and make sure that it never happened again. To make sure that no other family would have to hurt like this at the hands of someone's negligence.

We have since learned that because the divorce my sister had filed prior to her entering the hospital was not complete we (the mother and the siblings) have no rights to fight for her justice! Instead her "husband", the man that would keep two brothers apart for almost six months after the loss their mother, and that couldn't pay for a headstone from my sister's life insurance policy, but managed to have enough money left to fund a trip to Disney with his girlfriend and my sister's five year old son (less then two months after her death), is the one that has all the legal rights. Where is the justice in this?

We want to challenge the system.

We want the right to fight for our sister's justice!

We want to right to seek answers for what happened.

We want the right to stand up and fight so that her "husband" does not get what he shouldn't (due to the pending divorce) and make sure that both of her children are taken care and provided for equally since she worked so hard herself to do this for them while she was alive.

We want the right to say no to any compensation/settlement that does not include answers as to who/what killed her.

We want the right to know how/what is going to change so that this situation; this neglect, does not take someone else's Daughter/Sister/Mother!!!

For a Mother that has lost her first born, and for siblings that have not known life with out their big sister (their rock), please help us in collecting as many signatures of support as possible for the right to just be ALLOWED to fight for our sister's justice!
